1. Acceptance of Terms
By downloading, installing or using HexPulse ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
HexPulse is a puzzle game for iOS devices. The App provides hexagonal puzzle levels where players rotate tiles to connect energy sources to their targets. The App includes both free and Premium content.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on Apple devices that you own or control, subject to the Apple Media Services Terms and Conditions.
4. Free and Premium Content
The App offers free content including the first three level packs (150 levels), the Daily Circuit, Perfect Run for the free packs and one Time Attack run per day. Additional content, including level packs 4 through 25 (1100 levels), Endless Mode, Daily Circuit replay, unlimited Time Attack runs and bonus themes, is available through a one-time in-app purchase ("Premium Unlock").
- The Premium Unlock is a one-time purchase, not a subscription
- All purchases are processed by Apple through the App Store
- Purchases are non-refundable except as required by applicable law or Apple's refund policies
- You can restore your purchase on any device using the same Apple Account
5. User Conduct
You agree not to:
- Reverse engineer, decompile or disassemble the App
- Modify, adapt or create derivative works based on the App
- Distribute, license, sell or transfer the App or any part thereof
- Use the App for any unlawful purpose
- Attempt to circumvent in-app purchase mechanisms
6. Intellectual Property
All content in the App, including but not limited to game design, levels, graphics, animations, sounds and code, is the property of HexPulse and is protected by copyright and other intellectual property laws. All rights not expressly granted are reserved.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall HexPulse or its developers be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from your use of the App.
9. Third-Party Terms
Your use of the App is also subject to Apple's Terms and Conditions, including the Apple Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall govern to the extent of the conflict.
10. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
